Who can file a wrongful death claim in California?

California law allows a surviving spouse or domestic partner, children, and in some situations other dependents or heirs to bring a wrongful death claim. A separate survival action may also belong to the estate.

What damages are available?

Recoverable losses can include funeral and burial costs, financial support the person would have provided, and the loss of their love, companionship, and guidance.

Read more about how we handle these matters on our wrongful death practice page.
