Settlement vs. Trial: How California Injury Cases Actually End
Settlement and trial are not opposites so much as two endpoints on the same track. Most cases prepare for trial and settle along the way, often at mediation or on the eve of trial.
Settlement vs. Trial: side by side
| Factor | Settlement | Trial |
|---|---|---|
| Timing | Can resolve in months once treatment is complete. | Los Angeles civil trial dates commonly land a year or more after filing. |
| Certainty | The amount is known and agreed before you sign. | A jury may award more, less, or nothing at all. |
| Privacy | Terms are usually confidential. | Testimony and the verdict are part of the public record. |
| Case costs | Lower, since fewer experts and depositions are needed. | Higher: experts, exhibits, court reporters, and trial time. |
| Finality | A signed release ends the matter. | A verdict may be challenged post-trial or on appeal. |
| Control | You decide whether to accept. | The jury decides; you control only whether to try the case. |
Settlement usually fits when
- Liability is accepted and the medical picture is stable
- The offer reflects documented losses and future care
- You need resolution on a predictable timeline
Trial usually fits when
- The insurer disputes fault or denies the injury is related to the incident
- The best offer is far below documented losses
- Policy limits or a coverage dispute make negotiation unproductive
Common questions
Who decides whether to settle?
The client does. An attorney can recommend, evaluate, and negotiate, but only the client can accept or reject an offer.
What is mediation?
Mediation is a private settlement conference with a neutral third party, usually a retired judge or experienced attorney. It is not binding, and either side can walk away and continue to trial.
Does filing a lawsuit mean the case will go to trial?
No. Filing starts the litigation clock and often changes settlement posture, but most filed cases still resolve before a jury is selected.
